TERMS OF SERVICE
123connect provides World Wide Web page hosting. 123connect reserves the right to suspend or cancel a customer's access to any or all services provided by 123connect when 123connect decides that the account has been inappropriately used or otherwise.

EMAIL
With email now established as an integral part of many businesses we recommend you make regular backups by downloading email to your local system. The webmail facility provided is not to be used or considered as an online office, nor is it permitted to store email for a period greater than three months. If any email is stored for longer than three months it may be deleted by our support team without notice. If you are unable or unwilling to download your mail then we offer a backup service available via our hosting upgrades page. However you should be aware that this will only backup email currently in the mailbox(es) and again will not store email greater than three months old.

SERVER USE
Hosting accounts are to be used by the primary owner only. Hosting account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads and reseller accounts.

123connect reserves the right to refuse service and /or access to its servers to anyone.

123connect do not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of 123connect.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

SERVERS AND OUTAGES
123connect are not legally liable for the data that is hosted by a user, any opinions put forward in material hosted on a 123connect server are not representative of the views of the staff, or company as a whole.

By signing up for a 123connect hosting account the user automatically agree to pay for any legal fees or claims by a third party of loss or damage that result from an action originating from the material hosted on their account.

123connect are not legally liable for losses and/or damage to a company that may be a result of downtime on the 123connect servers or network. In addition 123connect is not legally liable for any losses and/or damage to a company which may be a result of domain registration/renewal or transfer issues . While 123connect shall attempt to provide the most reliable service possible, no guarantees as to the uptime of a server are made as part of this contract.

USAGE POLICY
123connect will allocate each domain a specific amount of monthly bandwidth to use, this is not transferrable nor can lesser usage be rolled over or offset against any other month. Excess usage will be charged at our base price of 10p per Mb or part therof unless agreed with the domain owner in writing. The basis for this charge will be the control panel statistics for the website to determine the total bandwidth used for each calender month.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization.123connect may implement the following policy to its sole discretion:

When a website is found to be monopolising the resources available 123connect reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby 123connect continues hosting the website for an additional fee.

PAYMENT POLICIES
All accounts are set up on a prepay basis. Although 123connect reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers may automatically be charged again at the end of their prepay period unless closure notification has already been given.

In situations where any card number on file is declined 123connect will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, 123connect reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

Bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via regular mail shortly after the online purchase has been made. At this point the customer's card will be charged automatically.

All payment is in UK sterling .

PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down 123connect runs a limited number of payment options.

Credit / Debit Cards:
123connect accepts Mastercard, Visa (not Visa electron), Switch and Solo. Payment can be made by Bank Transfer or by cheque on application to our accounts department

CANCELLATION AND REFUNDS
123connect reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes 123connect' terms of service a refund will not be issued in the event of a cancellation.

Customers may cancel their account at any time. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.

Hosting renewal fees not paid after 30 days will result in the domain being suspended. If the fees are not paid within 60days the domain will be deleted without recourse. 123connect will not be held accountable for any deleted content as a result of this. In the case of domain names non renewal may result in the total loss of the domain name and again, 123connect will not be liable or rsponsible for such loss regardless of cause

Fees charged on a prepay basis are non-refundable. Customers are not entitled to receive a refund unless the service is cancelled by 123connect. In addition some accounts incur set-up fees, these charges are also non-refundable.

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold 123connect harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against 123connect, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless 123connect against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with 123connect' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from 123connect' server.

DISCLAIMER
123connect will not be responsible for any damages your business may suffer. 123connect makes no warranties of any kind, expressed or implied for services we provide. 123connect disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by 123connect and its employees. 123connect reserves the right to revise its policies at any time
